General terms of competition

These competition conditions set out the competition rules on the hot-chip.eu website

Introductory Provisions

These General Competition Terms and Conditions (hereinafter referred to as the "Competition Terms") are the determination of the binding rules of the competition, on the basis of which the competitions run on the web server of the Competition Organizer will take place.

The relations that arise between the Organizer and the Contestants are governed by these Contest Terms and Conditions, unless otherwise specified, for example, by special Contest Terms and Conditions located on other web servers of the Organizer.

General terms

Organizer means: HOT-CHIP s.r.o. registered office at Náměstí 40, Paskov, 739 21, ID number: 09031669, registered in the commercial register maintained by the Regional Court in Ostrava, section C, insert 81660.

The organizer's server means: hot-chip.cz, hot-chip.eu and hot-chip.de

The territory in which the Competition is taking place is understood as: the territory of the European Union

Competitors are defined as: a natural person who accepts the competition rules and meets the conditions for participation in the competition and is over 15 years old. A person older than 15 years and younger than 18 years of age is responsible for the person during the Contest and when the Prize is handed over to their legal representative.

Competition means: "Hot Chip Challenge" consisting of:

consumed the entire Hot Chip Challenge chips, seasoned with the hottest chili pepper,
filmed a short video or took a photo in which he is recorded after consuming Hot Chip Challenge chips - when the product packaging or at least part of the product packaging is visibly recorded on the video or photo,
shared a short video or photo after consumption on a social network, namely Facebook, Instagram or Tik Tok, according to his choice and marked the post with the hashtag #hotchipchallenge,
invited at least 1 other person who is also to participate in the Hot Chip Challenge,
was drawn at random.

The winning order means: The order indicated by the Organizer in the announced Competition.
The announcement of the competition is understood as: the announcement of the Competition, published by the Organizer on the relevant Server or the Organizer's social networks and governed by these Competition Terms and Conditions.
The start of the Competition means: the day indicated as the start of the Competition in the Competition Announcement.
The end of the Competition means: the day marked as the end of the Competition in the Competition Announcement.

The prize is: the latest IPHONE 64 GB mobile phone

General rules

Participation in Competitions on the Organizer's server is always free.
The winner is always announced after the end of the Competition.
Any natural person over the age of 15 who agrees to these Competition Terms and General Terms and Conditions can participate in the competition, with the exception of employees and associates of the Organizer and their family members.
Contests organized by the Organizer may not be participated by persons who do not agree with these Contest Terms and Conditions or General Terms and Conditions.
The competition takes place every year and starts on 31.7. and ends on 31.7 of the following year.
The organizer of the Competition reserves the right to change, shorten, interrupt or cancel the competition. The Organizer will notify the Competitors of these facts properly and in time by publishing the information on the hot-chip.cz server
Contestants enter the Contest by:

consumes the entire Hot Chip Challenge chips, flavored with the hottest chili pepper,
films a short video or takes a photo in which he is recorded after consuming the Hot Chip Challenge chip - when the product packaging or at least part of the product packaging is visibly recorded on the video or photo
He then shares this short video or photo on a social network, namely Facebook, Instagram or Tik Tok, according to his choice, together with the tagged hashtag #hotchipchallenge
subsequently invites at least 1 other person who is also to participate in the Hot Chip Challenge and thus becomes an active Contestant in the organized Contest.

Each competitor can participate in the Competition only once.
The winner of the Contest will be determined by the Organizer by random drawing from all Contestants within 21 days after the end of the Contest period.
The Organizer of the Competition will announce the order of the Winners, immediately after the draw of the Contestants.
The Organizer will notify the Winner of the Prize no later than 5 working days after the Contestants have been drawn and their order has been determined, via the Organizer's server and the social networks through which the Winner shared his contribution as specified in Article 3.7 of these Contest Terms and Conditions.
The prize is handed over by the Organizer no later than 14 days after the announcement of the Winner, either in person or sent by post to the contact address provided by the winner when the Organizer announces the win. This fulfills the Organizer's obligation to hand over the prize to the Winner.
The prize cannot be exchanged for cash.
In this case, delivery via Česká pošta a.s. or another delivery service is considered delivery by post.
Contest Winnings are not guaranteed. The organizer is also not responsible for defects and damage to the object of the Prize from the moment it is handed over. The Contestant understands and fully agrees with this.
The Organizer does not assume any other obligations with respect to the contestants, and they are not entitled to any further performance by the Organizer other than that determined by these Competition Terms and Conditions.

Contestant's rights and obligations

The contestant declares that he participates in the Contest voluntarily.

The Contestant is obliged to provide the Organizer with complete and true contact details, which are necessary for obtaining and sending or handing over the Prize.

The contestant who became the Winner is obliged to respond to the Organizer's call within 5 working days.

In the event that the Winner does not respond to the Organizer's call within the set deadline, the Winner's right to the Prize will expire.

In the event that the Winner does not respond to his call, the Organizer reserves the right to determine a replacement Winner through a new random draw.

Communication by the Organizer will take place through social networks on which the Winner shared his reaction as defined in Article 3.7 of these Competition Terms.

If the Prize is not delivered to the Contestant within 14 working days of its announcement by the Organizer, the Contestant is entitled to contact the Organizer via the Organizer's contact details listed on the Organizer's server.

The contestant is obliged to behave in such a way that there is no violation of the applicable legal regulations of the Czech Republic and that his actions do not cause any harm to the Organizer or other contestants.

Rights and obligations of the Organizer

The Organizer is obliged to inform the Winner of the fact that he has become a Winner within 5 working days from the draw of the Contestants and the determination of their order, through the social networks through which he shared his contribution as stated in Article 3. 7. of these Contest Terms and Conditions .

The Organizer's obligation to issue the Prize to the Winner is fulfilled by handing it over in person at the Organizer's premises or by sending it to the address specified by the Winner or by receiving the Prize in person.

The Organizer bears no responsibility for any damage that the Prize may cause to the Winner, or to other persons who come into contact with the Prize.

The Organizer has the exclusive right to suspend, change or terminate the Competition without giving reasons, in the event of serious and unexpected events or events that would be affected by force majeure. In such a case, the Contestant has no right to compensation or settlement.

The Organizer bears no responsibility for any damages caused by the failure of systems and software and which do not originate from the Organizer's intentional actions. In such a case, the Organizer has the exclusive right to suspend, change or terminate the Competition without giving reasons. The contestant is not entitled to any compensation or settlement.

The Organizer is not responsible for damage to the Prize caused by the carrier who will be responsible for delivering the Prize to the Winner's address.

Personal data

All data obtained from Contestants is considered their personal data and is subject to protection pursuant to Act No. 110/2019 Coll. on the protection of personal data.

The competitor confirms that he understands that the provision of data is voluntary and that he has the right to access the data provided.

The Organizer undertakes that the personal data of the Contestants will not be passed on to any third party that is not in any way connected with the Organizer (e.g. the organization in question does not jointly announce the relevant competition with the Organizer).

The Contestant agrees that data containing the name, surname and city of the Contest Winner may be published on the Organizer's server.

Contestants hereby agree to receive information about new Contests and Prizes and advertising messages from the Organizer. In this case, this information will only be sent from the Organizer's system.

Final Provisions

These Competition Terms and Conditions are created in accordance with applicable laws and other legal regulations of the Czech Republic. The competitor confirms that he has been familiarized with the Competition Terms and undertakes to follow them.

The organizer reserves the right to make any changes and additions to these Competition Terms and Conditions. In this case, the Organizer will announce the changes by notification on its Servers.

These Competition Terms are valid from 11/29/2022.
